Ljubljana Court of Appeal recently has overturned a gag order against the Dnevnik newspaper. The Slovene daily ran articles in July that suggested an Italian businessman’s involvement in corruption. The gag order came on August 6.
Lawyers representing the businessman filed a civil defamation lawsuit and obtained a court order that banned the paper from further suggesting anything controversial about the businessman’s character.
A district court rejected the Dnevnik’s first appeal, but on Sept. 30 the Ljubljana Court of Appeal repealed the injunction, finding it “too invasive of freedom of expression,” according to the International Press Institute (IPI). The court stated, Dnevnik “reported on a topic which was of importance to the public,” and the businessman could employ his right of reply.
